Gusto Worldwide Media (collectively, “we”, “us”, “our”, “Gusto”) has established this Privacy Notice to outline how we collect, store, use, and disclose personal information of users of our App, Gusto TV (the “App”).

Gusto respects individual privacy and recognizes the need for appropriate protection and management of our customers’ personal information.

In this Privacy Notice, Personal Information means any information that can be used to identify you, either alone or in combination with other information (“Personal Information”).

Personal Information We Collect and How We Use It

When you interact with us through our App, we may collect the following Personal Information from you:

  • Contact Information: such as your name and email address;
  • Account Credentials: such as user name and password, which we use to provide you access to your account;
  • Information about you that you choose to provide to us: such as your location, gender, and age range, in order for us to better understand our viewers, to tailor our offerings based on viewer preferences, and to improve our services on the App;

We may collect the following Personal Information automatically:

  • Technical Information: Our App may collect URL information, online identifiers (such as cookie data and IP addresses), information about your device such as device IDs, network connection type (e.g., wifi, 4G, LTE, Bluetooth), provider, network and device performance information, browser type, language, information enabling digital rights management, operating system, and application version. We use this information to help us understand activity on our App and to monitor and improve our services.

You may refuse to provide us with your Personal Information. However, some Personal Information is necessary to fulfill our services. In these cases, we may not be able to provide you with the services available on the App.

We may also use information in aggregate form, in order to generate statistics about our operations and about content accessed by viewers (e.g., the number of viewers that have watched a specific show in a time period).

We may transfer Personal Information to third parties who act on our behalf (i.e., service providers), for further processing in accordance with the purpose(s) for which the Personal Information was originally collected.

Our App may include links to third-party websites as well as content and applications hosted and served by third parties that we do not own or operate. Clicking on those links may allow the third-party to collect or share Personal Information about you. If you follow a link to a third-party website, please refer to the third-party’s privacy notice for information on the type of Personal Information it collects, and how it uses or discloses it. We do not endorse and are not responsible for the information or privacy practices of websites or services owned by third parties.

It is possible that Personal Information we collect is processed by us and our service providers on servers inside and outside your province of residence or Canada.

Please note that your Personal Information may be subject to the laws of general application in the jurisdiction where it is stored, including lawful access. We have Personal Information retention processes designed to retain Personal Information of our customers for no longer than necessary for the purposes stated above or to otherwise meet legal requirements. We will destroy or anonymize information that is no longer required for the purpose for which it was collected.

You may also request that we delete the Personal Information under certain circumstances, unless it must be retained to fulfill the purposes for which it was collected, to protect our rights, or to exercise or defend against any legal claims.
